1. Introduction & Acceptance of Terms

Welcome to NearFixit. By accessing or using our website, platform, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and NearFixit regarding your use of the Platform.

2. Description of the Platform

NearFixit is a directory and marketplace connecting users seeking services ("Customers") with independent service professionals ("Providers").

Important Disclaimer: NearFixit is not an employer, general contractor, or service provider.

We provide a platform for connection but do not oversee, direct, or control the performance of services by Providers. We do not guarantee the quality, safety, or legality of the services provided. Any contract for services is directly between the Customer and the Provider.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Customers: May create accounts to search for Providers and leave reviews.
  • Providers: Must create accounts to list their services. Providers represent and warrant that they have all necessary licenses, insurance, and qualifications to perform the services they offer.

4. Provider Responsibilities

Providers agree to:

  • Provide accurate and truthful information in their profiles.
  • Perform services in a professional manner and in compliance with all applicable laws and regulations.
  • Maintain any required licenses and insurance.
  • Respect the privacy and property of Customers.

5. Reviews & User-Generated Content

Users may post reviews, ratings, and other content ("User Content"). You retain ownership of your User Content, but you grant NearFixit a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and distribute it.

Reviews must be based on actual first-hand experiences. You agree not to post content that is false, defamatory, harassing, or violates any third-party rights. Reviews reflect the opinions of users and do not represent the views of NearFixit.

6. Moderation & Removal Rights

NearFixit reserves the right, but has no obligation, to monitor, review, hide, or remove any User Content or Provider profile at our sole discretion. We may take action against content that violates these Terms, is reported by other users, or is deemed inappropriate by our administrators.

7. No Guarantees / No Endorsement

NearFixit does not endorse any specific Provider. The inclusion of a Provider on the Platform does not imply a recommendation. We make no representations or warranties regarding the quality, reliability, or safety of any Provider or their services. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

8. Limitation of Liability

To the fullest extent permitted by law, NearFixit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your access to or use of, or inability to access or use, the Platform.
  • Any conduct or content of any third party on the Platform, including Providers and other users.
  • Any services obtained through the Platform.

9. Termination & Suspension

We may suspend or terminate your access to the Platform at any time, for any reason, without notice or liability. Upon termination, your right to use the Platform will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any such change constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NearFixit operates, without regard to its conflict of law provisions.
